The International Criminal Court (ICC) prosecutor, Karim Khan, has stepped down temporarily due to an ongoing investigation into allegations of sexual misconduct. Khan has firmly denied the claims against him. The ICC confirmed that Khan communicated his decision to take a leave of absence while the U.N.’s Office of Internal Oversight Services conducts the inquiry. Women’s rights groups have voiced support for his leave, following the allegations, though Khan initially resisted stepping down.

The allegations surfaced last year, coinciding with Khan’s pursuit of arrest warrants against Israeli Prime Minister Benjamin Netanyahu, former Defense Minister Yoav Gallant, and Hamas leaders, accusing them of war crimes. The internal inquiry into Khan’s alleged misconduct revealed that a report was filed by two colleagues at the Hague, yet the investigation was closed when the accuser chose not to formally pursue the matter. While the inquiry did not find conclusive evidence of misconduct, it recommended that Khan limit his contact with the individual involved to preserve the integrity of the court.

Khan has faced mounting pressure, including U.S. sanctions, following his actions against Israeli leaders. The Wall Street Journal suggested that Khan’s decision to pursue these charges may have been a tactic to deflect attention from the sexual misconduct allegations against him, raising questions about the true motivations behind his actions.

In defense of Khan, his legal team has stated that the claims of sexual misconduct are false, and they insist that the arrest warrants against Israeli leaders were legally sound and independently approved by ICC judges. They argue that the charges against Israeli officials were based on solid evidence, and the suggestion that these actions were linked to the misconduct investigation is unfounded.

Legal figures like Hillel Neuer believe that the ICC’s actions are motivated by anti-Israel bias, rather than any commitment to justice or international law.
