Hong Kong Court Overturns China Critic Jimmy Lai’s Fraud Conviction in Rare Legal Victory

In HONG KONG a surprising legal development that has captured global attention, a Hong Kong appellate court on Thursday, February 26, 2026, overturned the fraud conviction and prison sentence of prominent pro-democracy media tycoon Jimmy Lai, in a rare legal victory for the veteran critic of the Chinese government.

The Hong Kong Court of Appeal ruled that the earlier trial judge had made significant errors in convicting Lai and a co-defendant over a 2022 fraud case linked to the lease and use of office space by Lai’s former media company, Apple Daily Printing. The appellate judges Jeremy Poon, Anthea Pang and Derek Pang granted leave to appeal, quashed both convictions and set aside the sentences imposed by the lower court.

Fraud Case Overturned but Lai Remains Imprisoned

The fraud conviction that was overturned stemmed from allegations that Lai and another executive had breached lease terms by allowing a private consultancy he controlled Dico Consultants Ltd to occupy space in the Apple Daily headquarters. Prosecutors had argued this amounted to taking unfair advantage and fraud, leading to Lai’s 2022 sentence of five years and nine months in prison and a 21-month sentence for his co-defendant.

However, the Court of Appeal found that the prosecution had failed to prove fraudulent intent beyond a reasonable doubt and that there was no duty to disclose the arrangement under the lease terms. As a result, both the convictions and prison terms from the fraud case were annulled.

Despite this legal win Lai aged 78, remains in custody serving a 20-year sentence handed down earlier this month in a separate and far more serious national security case under Hong Kong’s China-imposed law. That case resulted in convictions on charges of conspiracy to collude with foreign forces and publishing seditious materials charges that have drawn widespread international criticism and raised concerns about press freedom and civil liberties in Hong Kong.

Lai’s long legal battle emblematic of the tightening political environment in Hong Kong since Beijing imposed the national security law in 2020, has made him one of the most high-profile figures in debates over judicial independence and media freedom. Rights groups and foreign governments have repeatedly called for his release, citing his deteriorating health after years of detention and solitary confinement.

British government officials and human rights advocates have urged Hong Kong authorities to consider Lai’s well-being on humanitarian grounds.
